Many artists find the legal aspects of managing their art careers to be complicated and confusing. This course educates artists about the basic principles of artistic copyrights, contractual agreements and dispute resolution strategies. It is supported and promoted by CARFAC Ontario (Canadian Artists' Representation), and co-taught with Tanya Woods.
The course is structured as an intensive 1-day seminar covering a range of legal and practical issues. Following a brief introduction to each other and discussion of our objectives, we dive right into some substantive legal issues.
The day begins with an overview of key copyright concepts specifically relevant to artists. Those include, among other things, the types of works protected, the scope of protection, exceptions and limitations, ownership issues and collective administration.
We next canvass some basic contractual issues, such as the requirements for formation of a valid contract, standard and specific terms commonly contained within an agreement and possible remedies for breach of contract.
Another important aspect of the course is coverage of dispute resolution strategies including litigation, negotiation, mediation and arbitration. We explain and evaluate the pros and cons of each. This part of the course involves a valuable practical exercise, in which a participants take place in a simulated negotiation, receive feedback on their performance and discuss strategies for future success.
In addition to an opportunity to pose substantive or procedural questions throughout the session, the day concludes with a question and answer period where you can raise general matters that were not fully explored or live issues of specific concern.
